The ThunderBay works fine on my old intel Mac but within a few minutes of use on my M4 MacBook Air, the Mac kernel panics and I lose whatever I was working on. I just need to get the data off but both the Finder copies and Carbon Copy Cloner cause the KP.

Try pulling out the failing drive, that is likely causing the panics. I bet that will let you recover the data.
